Commissioner Wodtke pointed out that the memo talks of <br />rezoning the 4.8 acre parcel while the Resolution cites 3.9 <br />acres; Mr. Ragsdale explained that the request was for the <br />R-3 District as shown on the map; however, there is a road <br />that runs through, which they are not recommending rezoning. <br />The Chairman called for the question. It was voted on <br />and carried unanimously. <br />ORDINANCE NO. 82-6 <br />WHEREAS, the Board of County Commissioners of Indian <br />River County, Florida, did publish and send its Notice of Intent <br />to rezone the hereinafter described property and pursuant thereto <br />held a public hearing in relation thereto, at which parties in <br />interest and ciizens were heard; NOW, THEREFORE, <br />BE IT ORDAINED by the Board of County Commissioners of <br />Indian River County, Florida, that the Zoning Ordinance of Indian <br />River County, Florida, and the accompanying Zoning Map, be amended <br />as follows: <br />1. That the Zoning Map.be changed in order that the <br />following described --property situated in -Indian River <br />County, Florida, to -wit: <br />COMMENCE at the Northwest corner of the Northeast 1/4 <br />of the Northwest 1/4 of Section 17, Township 31S, Range 39E; thence <br />run S 890 - 38' - 22" E along the North line of said Section 17, <br />84.96 feet to the East R.O.W. of U.S. #1; thence S 250 - 57' <br />- 59" E, 39.05 feet to the intersection of the South R.O.W. of <br />State Department lateral ditch No. 5 and the East R.O.W. of U.S. <br />#1; thence S 890 - 38' - 22" E, along the South R.O.W. of lateral <br />ditch No. 5670' to the POINT OF BEGINNING; thence run S 250 <br />- 57' -59" E, 361.27 feet; thence S 890 - 38' - 22" E, 655 feet <br />more or less to the Indian River; thence Northwesterly along the <br />Indian River to the intersection with the southerly line of State <br />Department lateral ditch No. 5, recorded in O.R.B. 102, Page 347; <br />thence N 890 - 38' - 22" W, 623 feet more or less to the POINT <br />OF BEGINNING. <br />Containing 3.9 acres, more or less. <br />To be changed from R-3 Multiple Dwelling District to <br />R-lAA Single Family District. <br />MAR 171982 <br />All with the meaning and intent and as set forth and <br />described in said Zoning Regulations. <br />This Ordinance shall take effect March 23, 1982. <br />BoOK 49 pag44 <br />
