Commissioner Bird then brought up the area of <br />commercial rates, stating that since he has been informed by <br />the Attorney that we have the right in the agreement to <br />re-evaluate these at any time, he would prefer to commence <br />without the commercial rates and establish them in about one <br />year's time when we have some experience. <br />Motion was made by Commissioner Bird, seconded by <br />Commissioner Wodtke for purposes of discussion, to change <br />our position on commercial rates and not establish them at <br />this time. <br />Commissioner Wodtke stated that he could agree to this <br />Motion provided that on issuance of the franchise we have <br />notice from both franchisees what their commercial rates <br />will be and that we have the ability to change these after a <br />six month period. <br />Commissioner Fletcher brought up a point of order and <br />asked if there should be a Motion to reconsider. He did not <br />believe this had been done on the previous action. <br />Attorney Brandenburg agreed there should be a Motion to <br />reconsider and that the Board did not follow correct <br />parliamentary procedure on the last item, carrying out the <br />action in one step instead of two. `He explained that <br />motion to reconsider must be made by a person who voted on <br />the prevailing side of the previous action, and a majority <br />vote is sufficient for reconsideration. <br />On Motion by Commissioner Bird, seconded by Commis- <br />sioner Wodtke, the Board by a 4 to 1 vote, Commissioner <br />Lyons voting in opposition, agreed to reconsider the <br />commercial rate portion of the franchise. <br />Motion was made by Commissioner Wodtke that the County <br />will be notified of the commercial rates of the franchisees <br />upon issuance of the franchise and of any changes thereafter <br />and, after a six months' period, the County will establish a <br />commercial rate after a proper study being made by staff. <br />MAY 19 1982� 1'� <br />67 j <br />
