Brandenburg <br />County Attorney <br />May 10, 1982 FILE: <br />SUBJECT: Moratorium on the <br />Issuance of Concealed Weapons' <br />Permits and Indian River <br />County <br />Ph.D. <br />REFERENCES: <br />The Board of County Commissioners at their March 3, 1982 meeting <br />imposed a moratorium on the issuance of concealed weapons' permits. <br />As the Commission recalls, the moratorium was imposed because of an <br />inconsistency between the course for firearms handling safety <br />required by the ordinance and that actually available from the <br />Sheriff's Department together with difficulties in processing back- <br />ground checks on applicants. Section 8-16 of the County Code of <br />Law and Ordinances provides as follows: <br />"The Board of County Commissioners of Indian River <br />County, Florida, shall designate by resolution those <br />courses in instruction, satisfactory completion of which <br />_ is required for compliance with Section 8-12 of this <br />article, but in no case shall a course be designated <br />which fails as a minimum to meet the required criteria <br />for Class "G" statewide gun permits specified in Chapter <br />1C-3.17 of the Rules.of the Department of State for <br />private investigative agencies." <br />There are three alternatives available for eliminating the incon- <br />sistencies; <br />1- To make'the requirements of Section 8-16 of the County's Code <br />more lenient, thus complying with the current course available <br />at the Sheriff's -Department. <br />2- Request the Sheriff's Department to upgrade the course require- <br />ments to meet that specified in the County Code (i.e. required <br />criteria for Class G statewide gun permit). <br />3- Request the Sheriffs Department to review the criteria for <br />Class G statewide gun permits and recommend to the County <br />Commission a modified version of same that will satisfy the <br />needs of the County. <br />Because the requirements for such a course clearly fall within the <br />bailiwick of the Sheriff's Department, these writers recommend the <br />third alternative. It should be noted that once the course <br />requirements are specified by the Sheriff's Department and adopted <br />by the County Section 8-24 of the current law would allow the <br />County to charge an appropriate administrative fee to cover the <br />cost of classroom or range instruction. <br />Respectfully submitted, <br />C.
