AUG 10 1992 54 c 899 <br />ON MOTION by Commissioner Wodtke, SECONDED <br />by Commissioner Bird, the Board unanimously <br />adopted the Hospital Commercial Node Concept <br />as recommended. <br />B. Interval Ownershi <br />Mr. Challacombe next brought up the complex issue of <br />time sharing or interval ownership and where it should be <br />located in the Comprehensive Plan and the Zoning Code. He <br />stated that it is staff's feeling that this is basically a <br />transient use, and from a planning standpoint, they would <br />suggest that certain commercial areas be delineated for this <br />type of use. <br />Discussion followed re designating such use in the R-3 <br />zone which allows hotels, and Mr. Challacombe felt that <br />would be appropriate also. In respect to the question of <br />how to deal with this issue in terms of the Master Plan, he <br />did not have a specific answer, but noted that they are <br />looking at definition; the City Ordinance contains a <br />definition of hotels and motels and they look at the use <br />itself as transient quarters oriented to serving seasonal or <br />transient residents. He pointed out that State Statutes <br />prohibit zoning contingent upon ownership. <br />Attorney Brandenburg confirmed that there is a State <br />Statute that indicates you may look at time sharing with <br />respect to the use, but you may not distinguish because of <br />the form of ownership, which is difficult to interpret; it <br />is a residential use, but it is a transient residential use <br />and that is because of the form of ownership. The Attorney <br />felt that we would want to handle this within the Zoning <br />Code itself and not particularly speak to it in the Land Use <br />Plan. <br />Community Development Director King believed that <br />Robert Reider of the Vero Beach Civic Association has <br />26 <br />
