easements and land to be acquired shall also be furnished by the <br />Engineer at no additional cost. Negotiation for all land rights <br />shall be accomplished by the County, unless the County requests <br />the Engineer to perform these services in a subsequent addendum to <br />this agreement. In the event the Engineer is requested to perform <br />these services, the Engineer shall be compensated for such addi- <br />tional services. <br />(13) The Engineer further agrees to obtain and main- <br />tain at the Engineer's expense, such insurance as will protect him <br />and the County from claims under the Workman's Compensation Act <br />and from all claims for bodily injury, death or property damage <br />which may arise from the negligent performance by the Engineer or <br />by the Engineer's employees of the'Engineer's functions and <br />services required under this agreement. The Engineer will obtain <br />and maintain, at the Engineer's expense, Errors and Omission <br />Insurance of $3,000,000.00 with a maximum of $10,000.00 <br />deductible. <br />(14) The Engineer acknowledges that preparation and <br />submittal of all applicable permits through governmental regula- <br />tory agencies are included within the scope of basic compensation. <br />Any additional work required by regulatory agencies which estab- <br />lished such regulations after the date of this agreement shall be <br />an additional service and the County shall compensate the Engineer <br />in accorandance with Section V, Additional work, of this <br />agreement. <br />(15) The County proposes to construct the Sixteenth <br />Street Traffic Improvement in one phase. The Engineer will pre- <br />pare detailed construction drawings and contract documents for the <br />entire construction in one phase together with a maintenance of <br />traffic plan. <br />(16) The Engineer will attend all bid openings and <br />tabulate the bid proposals, make an analysis of the bids, and make <br />recommendations for awarding the contracts for construction. <br />(17) Compensation to the Engineer for basic services <br />and resident inspection shall be in accordance with Section B of <br />this agreement. <br />-7- 1 peF <br />AUG 181982 <br />
