SEC. t <br />ments which are found necessary in its judgment to effect- <br />uate the purposes of this section and carry out the spirit <br />and purpose of the zoning ordinance. <br />(F) A site plan, for the purposes of this section, shall include, <br />but not necessarily be limited to, the following plans, de- <br />signs, specifications and information: <br />(1) Site plan with grades or contours <br />(2) Elevations, floor plans and uses of all buildings and <br />structures <br />(3) Location and character of all outside facilities for <br />waste disposal <br />(4) All curb cuts, driveways, parking areas, loading areas, <br />and surfacing materials of same <br />(5) All pedestrian walks, mall, yards and open spaces <br />(6) Location, size, character, height and orientation of <br />all signs <br />(7) Location, height and general character of walls and <br />fences <br />(8) Location and general character of landscaped areas <br />The applicant may, at his option, submit a preliminary site <br />plan sketch indicating a general idea of how it is proposed <br />to develop the parcel. Upon approval of the sketch, the <br />application can then proceed to have a detail site plan pre- <br />pared in accordance with the requirements in this Section. <br />(G) MODIFICATION OF SITE PLAN. <br />Any change in use of buildings, structures, land or water, <br />or institution of new uses, or alteration of or additional <br />buildings or structures or erection of new buildings or <br />structures shall be in accordance with a new or modified <br />site plan conforming and approved pursuant to this section. <br />(H) APPROVAL NOT TRANSFERABLE - TIME LIMIT. <br />Whenever site approval shall have been granted, it shall not <br />be considered to run with the land. The site plan approval— <br />shall terminate twelve (12) months thereafter, if construct- <br />ion has not been started. Extensions may be made by the <br />Board of County Commissioners at its discretion. In the <br />event the property receiving site plan approval, shall be <br />sold, transferred, leased, or the ownership thereof changed <br />in any way whatsoever, the site approval shall become nyll <br />and void. <br />(I) SITE PLAN APPROVAL - PROCEDURE. <br />Upon the approval of such site plan by the County Zoning <br />Commission, a building permit may be issued by the Build- <br />ing Department of the County, provided, however, any appli- <br />cant for site plan approval, or any other person having any <br />legal interest therein may file an appeal to the Board of <br />County Commissioners to review the action of the County Zon- <br />ing Commission in allowing or disallowing such application <br />for site plan approval, which appeal shall be in writing and <br />filed with the Building Department within ten (10) days from <br />the date of the final action of the County Zoning Commission, <br />and shall be transmitted to the Board of County Commissioners <br />by the Building Department. The Board of County Commissioners <br />shall thereupon set a date for a public hearing with regard <br />to such appeal, after giving public notice thereof in such <br />manner as the Board of County Commissioners shall prescribe, <br />at which time all interested parties shall have the right to <br />appear before the Board of County Commissioners in regard <br />thereto and the Board of County Commissioners shall thereupon <br />render its decision therein. The decision of the Board of <br />County Commissioners shall be final, unless otherwise appeal- <br />ed to the courts. <br />-35- <br />
