9. Obligation of Subgrant Funds. Subgrant funds may not under any circumstances <br />be obligated prior to the effective date or subsequent to the termination date of the <br />subgrant period. Only project costs incurred on or after the effective date of the <br />subgrant application are eligible for reimbursement. <br />10. Subgrant Funding. The obligation of the State of Florida to reimburse subgrantees <br />for incurred cost will be subject to the availability of Federal Highway Safety funds. <br />11. Performance. Failure to perform in whole or in part any of the herein contained <br />agreements may result in termination of this subgrant <br />12. Audit BHS, NHTSA, FHWA, and the Auditor General of the State of Florida, or <br />any of their duly authorized representatives, shall have access for purpose of audit <br />and examination of any books, documents, papers, and records of the subgrantee, <br />and to relevant books and records of subgrantees and contractors, as provided by <br />the provisions of Section 402(a) of the Highway Safety Act of 1966, Public Law <br />89-564, as amended. <br />13. Equal Employment Opportunity. No person shall, on the grounds of race, creed, <br />color or national origin, be excluded from participation in, be refused the benefits <br />of, or be otherwise subjected to discrimination under subgrants awarded pursuant <br />to. P.L. 89-564, or any project, program, activity, or subgrant supported by such re- <br />quirements of Title VI of the Civil Rights Act of 1964, and all applicable require- <br />ments pursuant to the regulations of the Department of Commerce (Title 15, Code <br />of Federal Regulations, Part 8, which have been adopted by the Department of <br />Transportation). <br />14. Minority Business Enterprises. <br />(a) Policy. It is the policy of the Department of Transportation that minority <br />ubusiness enterprises as defined in 49 CFR Part 23 shall have the maximum <br />opportunity to participate in the performance of con -tracts financed in whole <br />or in part with Federal funds under this agreement Consequently, the MBE <br />requirements of 49 CFR Part 23 apply to this agreement. <br />(b) MBE Obligation . The recipient or its contractor agrees to ensure that <br />minority business enterprises as defined in 49 CFR Part 23 have the maximum <br />opportunity to participate in the performance of contracts and subcontracts <br />financed in whole or in part with Federal funds provided under this agreement. <br />In this regard, all recipients or contractors shall take all necessary and reason- <br />able steps in accordance with 49 CFR Part 23 to ensure that minority business <br />enterprises have the maximum opportunity to compete for and perform con- <br />tracts. Recipients and their contractors shall not discriminate on the basis of <br />race, color, national origin, or sex in the award and performance of DOT - <br />assisted contracts. <br />15. Special Conditions: <br />1. Position candidate should meet BHS approved minimum training <br />and experience requirements commensurate with position <br />responsibilities. <br />2. Requirement for supervision by graduate and/or professional <br />engineer may be waived only upon prior approval by the BHS <br />and the Federal Highway Administration. <br />3. Federal funds will be reimbursed up to 1000 of each salary claim <br />until all such funds allocated have been utilized. <br />4. In the event that the technician position becomes vacant during <br />the course of the grant period, the qualifications of any <br />candidate proposed to fill the vacant position must be approved <br />by the BHS and Federal Highway Administration prior to incurring <br />any federal funding assistance costs. <br />7 <br />L. <br />19 <br />SEP 151982- oax . .51 mud " ^ <br />
