This <br />freedom of choice should not be restricted by any level of <br />government except where there is a compelling public reason <br />to do so. Such reasons would include: <br />(1) prevent fraud, <br />(2) enforce contracts, <br />(3) preclude monopoly, <br />(4) damaging the environment; <br />(5) preventing one party from injuring another. <br />Impleme.ntAtion of the market study requirement would not <br />address any of the above stated reasons in the course <br />of a normal rezoning case or land use amendment. Im= <br />plementation would, however, deter developers and land- <br />owners from exercising free choice in selecting from <br />different services, locations and types of communities. <br />The market study requirement would place an additional <br />expense to development and would most likely be a prohibitive <br />expense on owners of small parcels of land. In the ten <br />months that the requirement has been in effect, at least <br />two proposals by small, single parcel owners were deferred <br />due to the market study requirement. <br />(B) Advantages of a Market Study: <br />The principle advantage of implementing the market study <br />requi.rPnLents is_to provide the County Commission with <br />additional information for use in making decisions related <br />to rezoning and land use amendments. This information is <br />especially useful where new nodes are to be established. <br />RECOIWENDATION <br />Staff recommends deletion of the market study requirement <br />a in the Land Use Element. <br />MOTION WAS MADE by Commissioner Lyons, SECONDED <br />by Commissioner Fletcher, to delete the market <br />study requirement in the Land Use Element as <br />recommended by staff. <br />Chairman Scurlock stated that he had some reservations <br />about deleting this requirement, but he would vote in favor <br />of it. <br />THE CHAIRMAN CALLED FOR THE QUESTION. <br />It was voted on and carried unanimously. <br />
