MOTION WAS MADE by Commissioner Bird, SECONDED <br />by Commissioner Wodtke, to accept staff <br />recommendation and grant a second extension of <br />preliminary plat approval of Rivergrove <br />Subdivision. <br />Discussion ensued as to whether work was in progress, <br />and Mr. King did not believe so. It was noted that this was <br />the first request for extension after the Land Use Plan was <br />adopted, and a 12 month extension would add up to 18 months <br />normally allowed. <br />Commissioner Fletcher pointed out that this subdivision <br />t — was platted prior to adoption of our Drainage Ordinance, <br />which would require information on the plat as well as the <br />deed stating that this is in a flood hazard area. <br />Discussion followed in regard to adding that <br />requirement to the Motion. <br />Community Development Director King did not feel we <br />should try to make a preliminary plat conform to an <br />ordinance which was adopted after its approval without <br />revising that plat, and the only way we can require that <br />they amend the preliminary plat is to turn down the request <br />for extension. <br />Commissioner Wodtke believed this is an overall <br />extension of the entire development and asked if we could <br />not grant the extension subject to putting stipulations on <br />the final plat and deed that it is in a flood plain area. <br />Mr. King believed that could be done, but noted it <br />would not mean they are in compliance with the Storm Water <br />Ordinance. <br />David Kabboord informed the Board that his father just <br />purchased this property from Mr. Padgett, and they would <br />like to see this extended 12 months.
