DATE: January 6, 1983 FILE: SD -82-12-003 <br />the Board of County #258 <br />Commissioners <br />DIVISION HEAD CONCURRENCE: <br />-44 <br />atrick Bruce King, I <br />FROM: Clare ZimmermanA t <br />Staff Planner UU <br />SUBJECT: Preliminary Plat Approval <br />of Luria's Plaza at <br />Vero Beach Subdivision <br />REFERENCES: <br />It is requested that the information presented herein be given <br />formal consideration by the Board of County Commissioners at their <br />regular meeting on January 19, 1983. <br />DESCRIPTION AND CONDITIONS: <br />Luria's Plaza Subdivision was created as a result of two outparcels <br />which front on U.S. #1 being separated from the Luria's Shopping <br />Plaza development by the owners. A condition of site plan approval <br />for this development was that the 3 lots and the extension of 10th <br />Avenue which were formed in the development process be platted and <br />recorded according to the County's Subdivision Ordinance 75-3 <br />The subject property is 12.98 acres in size. It is zoned C-1 Commercial, <br />and has a MXD Mixed -Use District land use designation. <br />ANALYSIS AND ALTERNATIVES: <br />The developer is authorized to make connections to both County <br />water and sewer facilities. <br />The applicant has agreed to provide access for Lots 1 and 2 onto <br />U.S. #1 from Lot 3. Thus, traffic from these lots will not have <br />to enter directly onto U.S. #1 However, the applicant has not <br />specified on the plat that a non -access -easement- - <br />on-access:easement__ alongLthe�eaatern <br />borders: of .rots 1 and 2 will be provided. The County recommends <br />that a 5' non -access easement be placed along the eastern borders <br />of Lots 1 and 2 to insure that ingress and egress directly onto <br />U.S. #1 from these sites is avoided. <br />Also, the applicant has dedicated a 20' right-of-way along U.S. #1 <br />to the public for future road widening. This dedication has been <br />indicated on the face of the plat, but has been omitted from the <br />Certificate of Dedication which the applicant hassubmitted to the <br />County. The applicant has agreed, in a letter to the County, to <br />correct this omission. The Certificate of Dedication will be altered <br />to iaciude the dedication of 20' of right-of-way along U.S. #1. <br />Right-of-way deeds for the unopened portion of 10th Avenue have also <br />been submitted to the County. <br />Drainage and utility easements have been provided by the applicant <br />as recommended by County Staff. <br />RECQMMENDATION: <br />Staff recommends that preliminary plat approval of Luria's <br />Plaza Subdivision be granted subject to the following conditions: <br />1) that a 5' non -access easement be placed along <br />the eastern borders of Lots 1 and 2 <br />2) that _the applicant change the Certificate of <br />Dedication to include the dedication to the <br />public of a 20' right-of-way along U.S. #1 <br />for future road widening. <br />35 <br />
