Commissioner Scurlock asked Mr. Zorc to clarify several <br />points in order to squelch once and for all rumors he has <br />heard about the Manor's operation. <br />Mr. Zorc stated that none of the members of the board <br />of directors has ever received payments from the Manor in 11 <br />years of operations, nor has he or any member of his family <br />profited from the construction or operation of the Manor. <br />Mr. Zorc explained that St. Francis Manor is not a <br />charitable organization which solicits contributions and it, <br />therefore, is exempt from registration under Chapter 496. <br />They do accept donations, however. He stated the only time <br />they had raised funds was back in 1974 when they conducted a <br />community -wide drive to raise funds to build the dining <br />room/recreation center so that it would be mortgage free. <br />The City of Vero Beach was the main sponsor and donated <br />$10,000 in a one-time only donation. This was the only <br />official fund raising program they had ever conducted. <br />Attorney Brandenburg agreed with Attorney Vocelle's <br />analysis and the opinion he has written for Mr. Zorc with <br />respect to compliance with the Charitable Solicitation Act <br />Chapter 496, which stated that the Manor has not solicited <br />funds within the meaning of that Chapter. He informed the <br />Board that he conveyed this opinion to Attorney O'Haire and <br />asked if he would like to present any other specific <br />instances of solicitation within that Chapter, for us to <br />review, but he has had no response. <br />Chairman Bird asked if we were in our legal right in <br />returning the $999 to the Manor for the meal subsidy. <br />Attorney Brandenburg advised we were, in respect to the <br />solicitation question. The other question was why did the <br />organization go into an inactive status with the Secretary <br />of State, and Mr. Zorc has explained that at one time they <br />had changed accounting firms which resulted in a brief delay <br />in paying a $10 corporation tax and they were automatically <br />29 <br />MAY 4 19 6,0 <br />8 <br />��� PAGE . <br />
