<br />AND DRAINAGE IMPROVEMENTS TO 23RD AVE-
<br />NUE. BETWEEN IST AND ATH STREETS;
<br />PROVIDING THE TOTAL ESTIMATED COST;
<br />METHOD OF PAYMENT OF ASSESSMENTS,
<br />NUMBER OF ANNUAL INSTALLMENTS, AND
<br />LEGAL DESCRIPTION OF THE AREA SPECIALLY
<br />BENEFITED.
<br />WHEREAS, the County Public Works Depart-
<br />ment
<br />epartment has received a public improvement petition,
<br />signed by more than % of the owners of property
<br />In the area to be specially benefited, requesting
<br />paving and drainage improvements to 23rd Ave-
<br />nue, between 1 at Street and 4th Street: and
<br />WHEREAS, the petition has been, verified and
<br />meets the requirements of Ordinance 81-27, and
<br />design work including cost estimates has bawl
<br />Completed by the Public works Department: and
<br />WHEREAS, the total estimated cost of the Pro-
<br />posed improvements is $55.486.36; and
<br />WHEREAS, the special assessment provided
<br />hereunder shall, for any given record owner of
<br />property within the area specialty benefited, be In
<br />an amount equal to that proportion of seventy-five
<br />percent (75%) of the total Cost of the project
<br />which the number of lineal feet of road frontage
<br />owned by the given owner bears to the total num-
<br />bar of lineal feet of road frontage within the area
<br />specially benefited, and shall become due and
<br />payable at the Office of the Tax Collector of In-
<br />dian River County ninety (90) days aver the final
<br />determination of the special assessment pursuant
<br />to Ordinance 81-27; and
<br />WHEREAS, Indian River County strait pay
<br />remaining twenty-five percent (25%) of tlr. IoW.

<br />WHEREAS, any special mit not paid
<br />within said ninety (90) day period shall bear inter
<br />est beyond the due date at a rate established by
<br />the Board of County Commissioners at the time of
<br />preparation of the final assessmient roll, and shall

<br />to be made twelve (12) months from the due to
<br />and the second to be made twenty-four (24)
<br />months from the due data. and
<br />WHEREAS, after examination of the nature and
<br />anticipated usage of the proposed Improvements.
<br />the Board of County Commissioners lois deter-
<br />mined that the following described properties
<br />shall receive direct and speaal benefit from theses
<br />improvements, to wit:
<br />Lots 17 through 32 Block C: Lots 1 through 16
<br />Block D; as shown on the Plat of Indian River
<br />Heights Unit 2 Subdivision an record in Plat Book,
<br />6 Page 25 of Public Records of Indian River'
<br />County, Florida.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE
<br />BOARD OF COUNTY COMMISSIONERS OF IN-
<br />DIAN RIVER COUNTY. FLORIDA, as foUtlws:
<br />1. The foregoing recitals are affirmed and rati-
<br />fied in their entirety. I
<br />2. A project providing ler paving and drainage,
<br />improvements to 23rd Avenue, between 1st Street.
<br />and 4th Street, heretofore designated as Public
<br />Works Project No. 8232, is hereby sproved sub-
<br />lect to the terms outlined above and all applicable
<br />irequirements of Ordinnce 81-27.
<br />i The foregoing resolution was offered by Com-
<br />tmissioner who moved its adoption.
