Leonard Nichol of Pebble Bay Villas, which is bordered on <br />several sides by the park, felt that a year or so ago when the <br />park was being discussed, an agreement had been worked out with <br />the Commission designating hours from sunup to sunset. He noted <br />that setting the hours from sunup to 9:00 P.M. makes that true <br />only for about two months out of the year while the balance of <br />the year the sun will set long before 9:00 P.M. Mr. Nichol felt <br />a regulation setting the hours from sunup to sunset would be <br />preferable. <br />Wally Hill, also of Pebble Beach Villas, concurred and <br />emphasized that after sundown is when there is a lot of <br />disturbance; there doesn't seem to be a problem during the <br />daylight hours. <br />Attorney Brandenburg reported that the hours set out in the <br />agreement referred to were formulated with due consideration <br />given the concerns of the general public and the fishermen, and <br />those hours were from sunup to 9:00 P.M. <br />Chairman Bird noted we were trying to reach some .type of <br />agreement with the Town of Indian River Shores re closing gates, <br />and it was felt a consistent time would be easier to regulate. <br />Discussion ensued as to the fact that sunset occurs at <br />different hours throughout the year. Commissioner Lyons sug- <br />gested setting the closing hour at 8:00 P.M. Standard Time and <br />9:00 P.M. Daylight Saving Time. Various other alternatives were <br />suggested, including wording stating that all people shall leave <br />the park "no later than 9:00 P.M.," and Attorney Brandenburg <br />stated there has to be some standard set; it cannot be <br />discretionary in the officer's mind. <br />Lee Pierce of Pebble Bay Villas favored a sunset closing <br />hour and did not feel closing the park at 6:00 P.M. would cause <br />any hardship. He also emphasized the need for a local arresting <br />officer, and wished to know why the Indian River Shores police <br />cannot be deputized to act as full arresting officers in the <br />County park. <br />Boa 53 P�� 3 <br />
