>I <br />• We <br />Chairman Bird explained the procedure this morning <br />would begin with the recommendation of staff. Then, after <br />questions or comments from the Board, the Public Hearing <br />would be opened. <br />Commissioner Scurlock asked if he could first express <br />his concern that more and more rezoning requests are <br />evolving into site plan presentations. He felt that <br />consideration and discussion should be limited to the <br />rezoning issue only. <br />Byron. T. Cooksey, Attorney for the applicant, requested <br />.an opportunity to explain his client's willingness to waive <br />the 45 -day appeal requirement, which he felt might save <br />everyone a substantial amount of time this morning. <br />Continuing, Mr. Cooksey stated that he realized this was a <br />rezoning appeal, but explained that every effort has been <br />made to cooperate in working with the owners of the adjacent <br />property, the Town officials and the County planning staff <br />in order to attempt a compromise in this matter. They have <br />been somewhat surprised with the opposition expressed at the <br />Planning and Zoning Commission; however, they do wish to <br />cooperate in achieving a harmonious development of the <br />property. To accomplish this, they are willing to waive any <br />45 -day appeal requirements and to request the Board to refer <br />this matter back to the Planning and Zoning Commission so <br />that the owners of the property can revise the plan in order <br />to develop a mutually acceptable plan to go forward with for <br />this land. <br />Commissioner Scurlock asked if the bottom line was a <br />request to waive the 45 -day appeal requirement, and that if <br />granted, the applicant could continue to appeal this <br />particular decision. <br />Attorney Brandenburg noted that when an individual <br />files an appeal, the County Commission, under Ordinance, has <br />the obligation to determine that appeal -within 45 days.
