JUN 15 1983 <br />$0 ox <br />53 <br />PA' <br />7 <br />explained that applicant is offering <br />to waive the <br />right <br />to <br />that determination within a 45 -day period so that the Board <br />can send the matter back to the Planning & Zoning Commission <br />to take a look at the revised plan and make a recommendation <br />on it. If the presentation were made today, the Board would <br />not have the recommendation of the revised plan by the <br />Planning & Zoning Commission as they would not have seen it. <br />Commissioner Scurlock pointed out that if the appeal <br />were considered today and denied, it could not be <br />resubmitted for a year. <br />MOTION WAS MADE by Commissioner Lyons, <br />SECONDED by Commissioner Wodtke, that <br />the Board accept the applicant's waiver of <br />the 45 -day period and remand the matter to <br />Planning & Zoning Commission to be reviewed <br />and readvertised under the Zoning Code, and <br />for the Planning & Zoning Commission to make <br />a recommendation on the revised plan. <br />Under discussion, Mr. Cooksey again emphasized that <br />every effort will be made to cooperate and to work out any <br />problems in order to satisfy everyone so that the plan can <br />proceed. <br />Commissioner Wodtke felt that this enclave really <br />should belong to the Town of Indian River Shores and hoped <br />that everyone involved could reach some kind of acceptable <br />plan for the use of this.property. <br />Commissioner Lyons felt that the best solution to this <br />problem would-be for the developer to request annexation to <br />the Town of Indian River Shores. <br />Commissioner Scurlock restated his feelings that this <br />appeal should stand on its merits as a zoning issue only, <br />rather than getting into site plan considerations.
