JUL 1983 <br />causes of action or liability of any type whatsoever caused by the <br />City's presence on the site or caused by anyone using the site <br />with actual or implied permission of the City or incurred by <br />anyone visiting the site. <br />10. In the event that the City abandons the premises or <br />uses the premises in a manner inconsistent with this lease then <br />the County may terminate this lease upon sixty (60) days written <br />notice delivered to the City Council. <br />11. The City shall comply with all applicable state, <br />federal and local laws and rules and regulations when applicable <br />to activities or uses conducted on site. <br />12. The City shall maintain the building and grounds <br />according to generally accepted good practices and shall comply <br />with all applicable health and safety laws, ordinances and codes. <br />13. The City shall arrange for and be responsible for <br />all utilities used on the premises. <br />14. The City agrees to maintain public liability <br />insurance in amounts not less than the City customarily carries <br />throughout the City with respect to injuries to persons and <br />properties, rights in or about the demised premises for the <br />property described in Exhibit "A" for the benefit of the County <br />and City and furnish to County copies of certificates of such <br />insurance. The City shall maintain fire and extended coverage <br />insurance covering the entire site and structures insuring against <br />direct physical loss and bodily injury and property damage in a <br />comprehensive public liability insurance form. In the event that <br />the structures upon the property are destroyed by fire or other <br />cause, the entire insurance proceeds available to the City shall <br />be used for reconstruction of facilities that will be used for <br />public purposes. The exact nature of the structure to be <br />reconstructed with such proceeds shall be agreed upon by the City <br />and the County. <br />15. It is further agreed that County's failure to <br />strictly enforce any of the terms or provisions hereof shall not <br />be deemed to be a waiver as to any subsequent breach of any <br />covenant, term agreement or condition contained herein. <br />- _3 - <br />
