OCT 19 198 P ri <br />55 <br />3) that the County has subscriptive rights to the road; <br />and 4) that our maintenance map has been correctly filed <br />and is in proper place, as that road has eroded over the <br />years. <br />Commissioner Lyons admitted he could not understand <br />this at all, and Attorney Brandenburg stated that the <br />problem is that Riverbend is having trouble marketing lots <br />facing Indian River as there is a title problem -- it is a <br />real dollar and cents matter. <br />Ruth Stanbridge, member of the Jungle Trail Committee, <br />apologized that the Jungle Trail Committee did not meet in <br />September. She reported that they would have had a permit <br />with the DER in regard to this right of way. It was to be <br />issued on October 3rd; however, on September 30th, Florida <br />Land Co. notified the DER that they had objections. She <br />reported that they are now into administrating hearings on <br />this matter. The erosion control permit would have <br />reestablished part of the road bed that was in the river. <br />She reported that they had already lost one grant of <br />$10,000, and another grant was pending. Without a permit <br />from the DER, they were stopped. She had understood that <br />Florida Land Co. would not object to the erosion control. <br />She also has problems with abandoning our maintenance map in <br />that section because it is almost like saying that we don't <br />.have rights to that road. <br />Attorney Brandenburg stated --that it is obviously a <br />boundary line dispute. If we shift the right of way <br />slightly to the east, Florida Land Co. would have the right <br />to apply for permits for such structures as a dock. <br />He pointed out that if the Board approves the right of way <br />shift, the roadway itself would not be moved. It would stay <br />where it is now. <br />Commissioner Lyons pointed out that the Jungle Trail <br />Committee has worked hard and long on this and he felt that <br />45 <br />® M M <br />
