NOV 1 b 1983 <br />15 PACE 77 <br />description has been written as to minimal qualifications <br />needed for this position. <br />2. The key definition "protected tree" is now defined as <br />any tree having a diameter at breast height of 8 inches or <br />greater; it originally was lo". It also includes trees that <br />do not necessarily get to that size, i.e., "significant <br />groupings of trees of the West Indian or tropical origin of <br />any size, and all mangroves regardless of size." Certain <br />trash trees are excluded and all citrus and sabal palmetto. <br />Mr. Paull continued that the criteria justifying <br />removal of the protected trees were reviewed and they are <br />now somewhat refined. There is a gross buildable area - net <br />buildable area concept, a rather complicated definition, <br />which was requested by the landscape architects. The <br />exemptions were reviewed, and there is one re routine <br />landscape maintenance which includes maintenance of dune <br />vegetation growing seaward of the Coastal Construction <br />Control Line if <br />permission has been given <br />by <br />the DNR. <br />The other parts <br />of the ordinance have to <br />do <br />with mangrove <br />alterations, hedging, etc., and trimming of mangroves during <br />any part of the year with the exception of a 2h month <br />period. Dune and shoreline vegetation is substantially the <br />same with an exception for construction of facilities or <br />structures that have some connection with public safety. <br />There is a section which addresses land clearing activities <br />and requires that an individual obtain a land clearing <br />permit before clearcutting a site whether he is removing <br />trees or not. <br />Commissioner Scurlock expressed concern about the <br />impact of the new septic tank ordinance on trees, as too <br />high a level of fill is very damaging to some varieties of <br />trees. <br />Attorney Paull believed that will be something the <br />Environmental Planner will want to look at on a case to case <br />M <br />
