FEB 1 1984 5 Q�$ <br />JAIL SITE RIGHT -OF -FIRST -REFUSAL AGREEMENT WITH THE CITY OF <br />VERO BEACH <br />Commissioner Lyons was concerned with Item #4 in the <br />proposed right -of -first -refusal agreement. He felt that the <br />County should be considered the most favorable prospect and, <br />as such, pay whatever the going rate is at the time of <br />purchase without getting down to the 10% consideration. <br />Attorney Brandenburg explained that Item #4 covers the <br />provision, that if in 10 or 15 years down the line the City <br />of Vero Beach adopts a policy other than 10% of fair market <br />value, we would be able to exercise our options. He noted <br />that it has taken quite some time to get this right -of -first <br />refusal agreement from the City and recommended that the <br />Board authorize its acceptance. <br />MOTION WAS MADE by Commissioner Lyons, <br />SECONDED by Commissioner Bowman, that the <br />Board approve the Right -of -First -Refusal <br />Agreement between the City of Vero Beach <br />and Indian"River County re purchase of the <br />jail site, and authorize the signature of the <br />Chairman. <br />Commissioner Lyons stated that out of fairness to the <br />City of Vero Beach, the loo is a requirement of the FCC. <br />It was agreed that the County is.actual-ly receiving a <br />free first -right -of -refusal. <br />THE CHAIRMAN CALLED FOR THE QUESTION. <br />The Motion was voted on and carried <br />unanimously. <br />28 <br />
