Development of the <br />subject property under its existing R-2 zoning would generate <br />55 AADT. <br />Environment <br />The subject property is not designated as environmentally <br />sensitive nor is it in a flood -prone area. <br />Utilities <br />County water is available for the subject property, but County <br />wastewater facilities are not available. <br />RECOMMENDATION <br />While the Planning and Zoning Commission voted to recommend <br />approval of this rezoning request, the Planning staff <br />recommends that this request be denied because a rezoning to <br />C-1 would be spot zoning and could result in conflicting land <br />uses abutting each other. However, if the Board concurs with <br />the Planning and Zoning Commission recommendation to rezone the <br />subject property to a commercial zoning district,'staff feels <br />that the County could rezone the -subject property to C-lA to <br />maintain a consistent zoning pattern or consider rezoning the <br />subject property to C-1 and additional commercial land in this <br />area from C-lA to C-1 to have a more logical zoning pattern. <br />Planner Shearer displayed slides of the subject area <br />and noted that it is located on a dirt road. He reported <br />that staff made several existing use surveys, and as far as <br />staff is concerned, rezoning to C-1 would be spot zoning <br />because of the small size of the property involved in the <br />proposed rezoning. Therefore, staff does not feel the C-1 <br />rezoning would be appropriate. There is C -IA to the east <br />and south, and it would be a natural continuation of that <br />zoning, but tire stores are not allowed in C -1A. Mr. <br />Shearer continued that the predominant use in this area is <br />residential, although there are a number of commercial uses. <br />He noted that the Planning & Zoning Commission did vote to <br />recommend approval, and if the Commission should wish to <br />allow the rezoning to C-1, staff recommends that the Commis- <br />sion consider rezoning additional commercial land in this <br />area to C-1 to provide a more consistent zoning pattern. <br />Commissioner Wodtke understood what staff is saying <br />about spot zoning, but he felt in an MXD District there <br />might be more latitude in this regard. <br />17 <br />MAR 211984 BOOK '56 PACE462 <br />
