Chairman Scurlock noted that another problem is that <br />easements may be needed from Vista, and Mr. Pinto believed <br />there is no question about that. He felt our position <br />however, is that if some private entity wants to connect, <br />they have to be in a position to pay all the costs to do so - <br />and to jump all the hurdles to get to that point, and if <br />they can do this, Mr. Pinto stated that he would much rather <br />see that happen than build another plant. <br />Chairman Scurlock felt there is no question that in the <br />long haul what we are going to look at is another plant in <br />the South County and an eventual phasing out of the Vista <br />plant. <br />Mr. Pinto agreed, and stated his concern is that it <br />will be easier to phase out two plants than ten plants. <br />Question arose about sewer service for the commercial <br />property that Vista retained in front of Vista Royale, and <br />Mr. Pinto stated that everything Vista owns is supposedly to <br />be served by that system. <br />Discussion ensued regarding the plants' capacity, and <br />Attorney Brandenburg reported that Vista guaranteed us <br />100,000 gallons of capacity out of the combination of the <br />Vista Royale and the Vista Gardens facilities. However, <br />there is a clause in the agreement which indicated that in <br />the event Vista did not build out to its maximum expansion, <br />that it would not be responsible for the failure of the <br />system to provide that guaranteed amount. <br />Discussion continued at length re the property on which <br />Mr. Lyon wishes to build a restaurant, among other things, <br />and Chairman Scurlock felt there are many parallel <br />situations in the county - for instance, the proposed <br />restaurant on the Moon property on SR 60 where we are moving <br />ahead with a subregional system in cooperation with various <br />developers.
