Stewart, attorney representing the <br />appellant, St. Edward's School, thought it was always <br />helpful when we get into site plan to go back to the basic <br />ordinance that addresses what criteria are to be considered <br />by the reviewing body in evaluating a site plan. He cited <br />several provisions in County ordinances relating to site <br />plans: <br />1) "The function of the Ordinance as a whole is to determine <br />and control environmental, ecological -economic impact, to <br />insure continuity of traffic patterns and development <br />compatible with surrounding property and provide for <br />conformity to County development and the Comprehensive Land <br />Use Plan." <br />2) "In reviewing such site plan, the Commission shall <br />consider the location, size, height, spacing appearance, <br />character and utilization of any building, structure or use <br />and their appurtences, access and circulation of vehicles <br />and pedestrians, streets, parking areas, open spaces and <br />landscaping in relation to adjacent property and access to <br />utility systems." <br />3) "The Commission shall not approve such site plan unless <br />it finds such site plan conforms to all applicable <br />conditions of the Zoning Ordinance, that the safety and <br />convenience of the public are properly provided for, that <br />adequate offstreet parking and loading facilities are. <br />provided for owners, tenants, visitors and employees, and <br />that adequate protection and separation are provided for <br />contiguous and nearby residential property." <br />4) "The Commission shall review site plan subject to <br />criteria, including but not limited to, to the zoning, <br />landscaping and subdivision ordinances, and may require <br />those changes that are deemed necessary for the protection <br />and promotion of the health, safety and general welfare of <br />the public." <br />48 <br />
