The residents feel that the volume and speed of <br />the traffic create a danger for the young children in the area <br />as there are no sidewalks along the street. 14th Street is the <br />demarcation line between the single-family neighborhood to the <br />south and the multi -family neighborhood to the north. It is <br />also the Vero Beach/Indian River County interface. <br />ANALYSIS: <br />The continuity of 40th Avenue as a local subdivision road <br />between 12th Street and State Road 60 is not desirable as it <br />does not discourage through traffic or excessive speed. Safe <br />pedestrian travel is also hindered by such a roadway pattern. <br />On January 19, 1983, the County Commission vacated the plat of <br />Ravina Gardens Subdivision which was to be developed immediate- <br />ly west of Phyl-Ann Terrace. The plat depicted a single street <br />(41st Avenue) extending from 12th Street north to 14th Street. <br />41st Avenue was to continue north to 16th Street through a <br />multi -family development. At the time of vacation of the <br />Ravina Gardens plat, the Commission granted preliminary plat <br />approval for Laurel Court Subdivision. Laurel Court was <br />designed with access off of 12th Street and a cul-de-sac at <br />14th Street in order to separate the single-family subdivision <br />from the multi -family neighborhood to the north. The approved <br />plat is identical to the situation which the residents of <br />Phyl-Ann Terrace wish to create. Planning principles incor- <br />porated into the Comprehensive Plan encourage the separation of <br />multi -family and single-family neighborhoods. The proposed <br />project will serve as a buffer between the differing high and <br />low intensity uses and decrease the volume of through traffic <br />entering both the single-family neighborhood and multi -family <br />neighborhood, an area populated by even more children than the <br />single-family section. <br />Existing right-of-way on 40th Avenue is 60 feet, which is <br />adequate to construct a cul-de-sac with a 30 foot radius. It <br />will be necessary to obtain additional right-of-way around the <br />cul-de-sac in order to ensure proper drainage. Currently the <br />lots drain towards the front, and miami curbs route the run-off <br />towards 12th Street.. The construction of the cul-de-sac at <br />14th Street will not inhibit the existing drainage pattern. It <br />is recommended that portions of the pavement in the 13th Street <br />right-of-way be removed in order to allow for an even more <br />improved drainage system. A section of pavement will have to <br />remain as the residence at the northeast corner of 40th Avenue <br />and 13th Street is accessed off of 13th Street. <br />Law enforcement, fire, and ambulance service to the residents <br />of 40th Avenue between 12th and 16th Streets will not be <br />negatively impacted by the proposed cul-de-sac. The multi- <br />family area to the north will be easily accessed via 16th <br />Street and Phyl-Ann Terrace by way of 12th Street. <br />Due to the fact that there are 10 projects on the waiting list <br />for then County Petition Paving Program, the proposed project <br />could not be scheduled for approximately 9 months. It would be <br />preferable for the construction to be done by an outside <br />contractor, although the engineering can be done by the County <br />Engineering Department. It is also recommended that the County <br />not be responsible for maintaining the landscaped area designed <br />as a buffer for the cul-de-sac. <br />RECOMMENDATION: <br />The Planning Staff recommends that the Board grant conceptual <br />approval of the right-of-way abandonment and instruct the <br />Engineering Department to prepare construction drawings of the <br />cul-de-sac and a preliminary assessment. It is recommended <br />that the Engineering Department then advertise a public hearing <br />regarding the abandonment of right-of-way and the retention of <br />easements, approval of which should be followed by the creation <br />of the actual assessment roll. <br />47 <br />J UN 6 1984 <br />BOOK 57 PAGE 3x,19 <br />f <br />
