JUL 111984 <br />BOOK 57 Fm,),E 599 <br />Chairman Scurlock opened the Public Hearing and asked <br />if anyone wished to be heard in this matter. <br />Leon Foster, resident in the area, asked how far the <br />C-1 District extends as he was concerned about several <br />people who have homes in that area which has been zoned <br />residential for many years. <br />After pointing out the perimeters of the area being <br />proposed for rezoning, Mr. Shearer explained that this <br />proposal does not include any property that is presently <br />zoned residential, only that which is presently zoned <br />restricted commercial, and staff is recommending that the <br />zoning be changed to C-1, which will not create any new <br />non -conforming uses. Most of the residences are to the <br />south end of the area, and the north end is occupied by <br />packing houses and associated uses. <br />Chairman Scurlock noted that if these homes were built <br />just recently, they would have had to be in a residential <br />district or they would not have received a building permit. <br />Commissioner Wodtke asked if this rezoning request <br />could be approved with the understanding that it would not <br />affect residential uses in that particular area, and Mr. <br />Shearer felt that would be very difficult because the <br />residential uses are so scattered. He asked, however, if <br />the Commissioners would like to exclude the parcel that is <br />next to the R-2 and then have staff come back with a request <br />to rezone it to R-2. <br />Commissioner Bird thought it might be difficult to <br />exclude only the property of the people represented here <br />when there might be some other residential uses in that area <br />that also qualify. <br />Mr. Shearer confirmed that there are approximately 20 <br />non -conforming residential uses scattered throughout the <br />area, but stressed that the issue here is that only <br />presently zoned C-lA property would be affected. <br />18 <br />
