2. fir. Lyons must pay all required connection and impact fees. <br />3. A bond or appropriate funding should be provided to expand the <br />Vista Gardens wastewater plant if, as a result of the flows from <br />the subject project, an expansion of the Vista Garden facility <br />becomes necessary to accomodate future flows at buildout of <br />Vista Garden. <br />Staff feels the bond or appropriate funding is necessary since <br />the county, through agreements, is committed to provide adequate <br />service to the Vista Gardens development at buildout. <br />4. If an alternative means of effluent disposal becomes available <br />to Mr. Lyons prior to completing construction of the site plan, I <br />the alternative must be implemented rather than utilizing the I <br />Vista Gardens facility. <br />Director Pinto explained that what we have is someone <br />who is building on Route 1. His property is adjacent to two <br />existing sewerage treatment plants - one at Vista Gardens <br />where we feel there is some capacity that can be utilized <br />even though we do have a commitment when.the plant is turned <br />over to us that it has to accommodate Vista Properties total <br />build -out. He noted that the alternatives are what concerns <br />staff, i.e., one alternative being to wait until the final <br />master plan is completed and the build -out of Vista <br />properties. If this means construction of another treatment <br />plant, staff feels the best alternative for the County is to <br />utilize the plants we have to the very maximum. Mr. Pinto <br />felt strongly that any plant that is near capacity, we would <br />not want to have people buy up and reserve capacity, but <br />rather that the capacity should be available for whoever is <br />ready to build, has site plans, etc. <br />Commissioner Wodtke stated that he did feel it is <br />logical that those who are closest to the plant should <br />connect. <br />Chairman Scurlock agreed and emphasized that we must <br />have a consistent, well thought-out, firm policy, and <br />proximity should be one of the considerations. <br />Discussion ensued re our commitment to reserve enough <br />capacity for the build -out of Vista Properties, both <br />residential and commercial, and Utilities Director Pinto <br />42 <br />AUG 11994 Boa `� PnE 86 <br />
