Commissioner Wodtke questioned Item A in Section XI re court appearances and conferences, and asked if the $1600 will be returned if we do not -have two days in court. Attorney Brandenburg explained that was an item that was added at our request. Our concern was that in the event the County was challenged on the impact fee, we didn't feel it was fair to have to pay the consultant to come back and justify the work for which he was already paid. To take care of that proviso, certain allowances for court time were included in the contract.
