Chief of Long -Range Planning, Richard Shearer, presented <br />staff's recommendation for approval of this rezoning request. He <br />explained that the R2 -C, multiple -family zoning district would <br />allow up to 12 units per acre, but the owners have included a <br />letter with their application that states they would keep the <br />density to 10 units per acre. Since the County does not have a <br />zoning district which allows 10 units per acre, staff went with <br />the R2 -C zoning because it is the closest available zoning <br />district in the MD -2 land use designation. <br />Chairman Scurlock stressed that the Comp Plan land use does <br />control the overall density in this area and asked what the <br />transfer of units would amount to. Mr. Shearer explained that <br />they have a credit of one unit per acre for each of the environ- <br />mentally sensitive acres. Under this the plan would allow about <br />240 dwelling units for the entire property of 57.22 acres, but <br />the development would be concentrated on the upland properties. <br />Chairman Scurlock noted that in addition there will be the <br />density transfers from the road right-of-way donated for the <br />extension of Indian River Boulevard, and Mr. Shearer estimated <br />that there probably will be 16 units per acre on the 17 acres of <br />buildable upland property. Tropic Villas has a density of 12-14. <br />Chairman Scurlock felt that these densities are even higher <br />than in the MXD District, and Mr. Shearer explained that it was <br />not always staff's position to recommend the maximum allowable <br />density under the Comp Plan, but in some cases they do. <br />Commissioner Bird asked if a land use cap of 12 units per <br />acre must be adhered to when density transfers are involved. <br />Attorney Brandenburg felt it was a debatable point, but <br />staff's position is that these densities would be allowed under <br />the Comprehensive Land Use Plan. <br />Robert Keating, Director of Planning & Development, clarified <br />that the applicant has agreed not to exceed 10 units per acre on <br />the total overall acreage of the site, including the environmentally <br />sensitive area, and the donated right-of-way, and Mr. Shearer <br />23 <br />NOV 28 1984 BOOK . 9 FACE $3 <br />
