JAN 21935 BOOK .� ' FX26 <br />Planner Shearer reported that the applicant has the <br />alternative of applying for amendment of the Land Use Plan, but <br />at the present, staff did not see any way for the property to be <br />rezoned. <br />Commissioner Bowman noted that they could file for that <br />redesignation right now, and Mr. Shearer agreed, but noted that <br />the process takes 2h-3 months. He further noted that they can <br />apply for rezoning and a Comprehensive Plan amendment at the same <br />time, and, in fact, are allowed a reduced rate if they do so. <br />Attorney Michael O'Haire appeared representing the Poteats, <br />who have lived on this property about twenty years. Mr. O'Haire <br />presented a colored sketch depicting the node as presented by <br />staff, which he felt clearly demonstrates that this is a wierd <br />stretched -out node. Mr. O'Haire pointed out that there are 49 <br />acres of commercial in -fill in this node and 39 acres of <br />residential in -fill ("in -fill" being property for which the <br />owners have expressed neither an inclination nor need to have <br />rezoned). He did agree with staff that the line has to be drawn <br />somewhere, but did not believe this is a good rezoning in <br />relation to what is actually taking place in this area. Mr. <br />O'Haire felt it would make more sense to eliminate this long <br />skinny node and have two nodes - one at 43rd Avenue and one at <br />King's Highway, and he did not believe staff would have a problem <br />with what his client is requesting except that there is no more <br />property in the node other than the "in -fill." He, therefore, <br />requested that the Commission dip into the in -fill category to <br />provide his clients with what he felt is a reasonable request. <br />Director Keating felt if you don't consider in -fill, you <br />really don't have a node. <br />Attorney O'Haire contended that this is not a rational node <br />and that it was artificially created. <br />Commissioner Bowman believed we are kidding ourselves if we <br />think we are not going to have a strip of commercial all along SR <br />60. <br />36 <br />
