JAN 16 1985 . aooK 5 r <br />AGREEMENT BETWEEN THE TOWN OF ORCHID <br />AND INDIAN RIVER COUNTY, FLORIDA <br />RE: THE ALLOCATION OF TRAFFIC CAPACITY ON ORCHID ISLAND <br />WHEREAS, on October 8, 1982, Governor Bob Graham, as <br />Chief Planning Officer of the State of Florida, and in recognition <br />of the unique characteristics of Hutchinson Island and the growth <br />pattern prevalent along the Treasure Coast, appointed the <br />Hutchinson Island Resource Planning and Management Committee (the <br />Committee), pursuant to Florida Statutes §380.45, and <br />WHEREAS, the Committee developed the Hutchinson Island <br />Resource Management Plan (Management Plan) and formally adopted <br />the Plan on October 6, 1983, and <br />WHEREAS, subsequently .the Governor and Cabinet of the <br />State of <br />Florida began the process <br />of <br />designating <br />Orchid <br />Island, <br />excluding <br />the unincorporated area <br />of <br />Indian River <br />County, <br />as an <br />area of critical State concern, and <br />WHEREAS, Indian River County by virtue of Resolution No. <br />84-105 publicly stated and documented its intent to work with the <br />. Town of Orchid to prepare a traffic allocation plan in accordance <br />with the Hutchinson Island Resource Planning and Management <br />Committee's recommendations and to submit such plan to the <br />Department of Community Affairs for its review and comment, and <br />WHEREAS, the Town of Orchid desires to supply the <br />Department of Community Affairs with an allocation plan by January <br />23, 1985, in an attempt to be removed from the area of critical <br />State concern designation. <br />NOW, THEREFORE, the Town of Orchid (Town) and Indian <br />River County ( County) now set forth their understandings and <br />agreement with respect to the allocation of traffic on Orchid <br />Island: <br />1. Of the total vacant buildable acreage within the <br />traffic zone #1 in the Management Plan, 78% of the acreage lies <br />within the unincorporated County and 22% of the buildable acreage <br />lies within the Town. The Town and County agree to use this <br />percentage as a base for the allocation until such time as both <br />agree to more accurate figures. <br />-1- <br />
