M M M <br />the public records before the subdivision ordinance was passed, <br />and it is not a legitimate plat as there are no County maintained <br />roads, ditches or drainage system. <br />Attorney O'Haire advised that he also has been approached by <br />a number of other owners of property along the south side CR -512 <br />in this vicinity to request a rezoning. These people feel that <br />this initial request is more or less a trial balloon, and they <br />also feel very strongly that it is not spot zoning. To the <br />contrary, they feel that having R-lE immediately south of a <br />30 -foot paved road, north of which is a commercial/industrial <br />node, constitutes spot zoning. He noted that the property <br />between the Hetra property and I-95 on the north side of CR -512 <br />is "infill" property, and nowhere is it cast in concrete that the <br />commercial boundary must be on the north side of CR -512. <br />Attorney O'Haire pointed out that the commercial node at SR -60 <br />and Kings Highway, which stretches from Kings Highway to 43rd <br />Avenue, zigzags back and forth across SR -60, and he felt this <br />request would be consistent with what was done in that node. <br />Attorney O'Haire continued that his client is the first to <br />request a commercial use on a piece of property south of CR -512, <br />and he believed that the zoning will be tested as time goes by <br />and people have actual uses for the property in that area. Given <br />the fact that the subject property is across the road from a <br />commercial/industrial node that consists of infill property and <br />that there is a projected industrial use for property east of <br />I-95, he argued that it would be entirely appropriate for the <br />subject property to be developed as commercial, rather than R-lE, <br />which is is the most restricted residential district in the <br />County, and therefore, it would be appropriate for the Board to <br />give consideration to a modification of the Comp Plan as well as <br />a change in zoning. <br />21 <br />L- JAN 2 3 1985 <br />BOOK 5.9 PvF 642 <br />
