Transportation System <br />BOQK 60 f,; r 379 <br />The subject property has direct access to Jungle Trail <br />(classified as a Scenic Road), and the subdivision will have <br />direct access to State Road A -1-A (classified as an arterial <br />street on the Thoroughfare Plan). The maximum development of <br />the subject property could generate up to 320 average annual <br />daily trips. <br />Environment <br />The subject property is not designated as environmentally <br />sensitive. However, approximately one-half of the subject <br />property is in an A-9 Flood Hazard Zone (Elevation 6) which <br />designates areas within the 100 year floodplain. In addition, <br />approximately five acres of the subject property contains a <br />mangrove marsh. <br />Utilities <br />County water and wastewater facilities are not available for <br />the subject property. <br />RECOMMENDATION <br />Based on the above analysis, including the Planning and Zoning <br />commission's recommendation, staff recommends approval. <br />Chairman Lyons felt this is a different action than we have <br />been asked to take before. Normally a place is annexed first and <br />then the question of the zoning comes up as to whether we will <br />waive the two year rule. <br />Attorney Brandenburg stated that, in essence, this is asking <br />the County to waive that rule. <br />Chairman Lyons felt this is sort of like a contract, and, in <br />effect, we are saying we rezone this. <br />Attorney Brandenburg clarified that we are only saying if it <br />is annexed and if they wish to rezone it, we will not object. <br />There is no contract on it, and we are not guaranteeing that <br />rezoning. If the Board indicates that they have no objection, he <br />believed the requirements of the statute have been met. <br />The County Attorney felt the Commission also should be aware <br />that the applicant has applied for a realignment of Jungle Trail <br />together with a proposal to do some minor stabilization, and this <br />matter will be scheduled for the next Board meeting. <br />Commissioner Wodtke commented that the title on this memo <br />says "Request to Rezone," but actually we are not rezoning.
