MAY 15 1995 <br />BOOK <br />60 <br />wF 8.4 <br />changes <br />and would like to review the proposed ordinance <br />page <br />by <br />page. <br />Commissioner Scurlock suggested that staff present their <br />changes for the Board to consider and comment on before the floor <br />is opened to the public. <br />Director Keating stated that the first change is on Page 2 <br />and it is just cleaning up language. <br />Item 12, Page 2, the very last paragraph, the revised <br />language is as follows: "Parking areas and driveways are allowed <br />to encroach within required side yards of multiple family <br />residential and nonresidential districts. On single family zoned <br />lots, driveways must be located at a minimum of 5' from the <br />nearest side lot line at the point of intersection with the <br />right-of-way." <br />Director Keating continued that the other change is on <br />Page 20 and 21 - STORMWATER DISCHARGE FROM SINGLE FAMILY LOTS. <br />This is a new section, and it is something the Public Works <br />Director, the Building Director, and he, feel is important. He <br />believed the County Attorney agrees with the concept but is not <br />satisfied with the language. This change would require that <br />single family lots have adequate drainage so they do not impact <br />another person's property. <br />Attorney Brandenburg stated that he did not have any diffi- <br />culty with the concept and understood the need, but the way it is <br />written now, in a subdivision platted a long time ago that does <br />not have drainage easements, an individual would not be able to <br />build a <br />house on <br />a lot <br />because <br />you <br />cannot <br />have any water dis- <br />charge, <br />and it is <br />not <br />clear if <br />this <br />means <br />normal rate discharge <br />or from a hurricane, etc. In order to build in these old subdi- <br />visions, an individual would have to obtain easements from <br />everyone else in the subdivision. Attorney Brandenburg did not <br />feel this is really workable and believed staff would have a <br />problem applying and enforcing it. Also, if staff didn't catch <br />it, the individual who is flooded could come back to the county <br />26 <br />
