and claim the county has been negligent in enforcing their law <br />and, therefore, is liable for flooding his house. The County <br />Attorney agreed this problem should be addressed but probably not <br />In this manner. <br />Public Works Director Davis stated that the intent of this <br />provision simply was to prevent "sheet flow" onto someone else's <br />property and mitigate any possible drainage problems by getting <br />that water to a drainage system. If we are creating a hill next <br />door, we don't want the drainage to impact someone else and would <br />like some type of provision to require a common line swale to <br />carry the water. If the present wording is prohibitive, that was <br />not the intent, but if there is no drainage system, that is a <br />dilemma and will have to be tackled in all these areas. <br />Commissioner Bird noted that in old subdivisions with 50' <br />lots, persons building now are required to have a much higher <br />elevation, and what do you do about a swale in these limited size <br />lots? <br />Commissioner Scurlock commented that this situation is <br />pointed out dramatically where he just built his new house <br />because his slab actually is level with his neighbor's window. <br />He looked into a drainfield system, but all you have to work with <br />is his 10' on his side and his neighbor's 101, and it is not fair <br />to either. He noted that it is not up to him to solve the <br />neighborhood's problem, but it also is not fair for him to <br />discharge his runoff right onto his neighbor's property. <br />Commissioner Bird felt possibly we can only address this in <br />new subdivisions, but Attorney Brandenburg pointed out that the <br />county also has standards from the Federal Flood Insurance <br />Program, and we have a problem right now with situations where <br />someone has to build substantially higher than the lots next to <br />him. He suggested the following language as a possible solution: <br />"For any individual single family lots a building permit shall <br />not be given the owner or his agent until he first certifies and <br />shows sufficient drainage exists, in the opinion of the owner, to <br />27 <br />MAY 15 198 Bofl 0 F,.GE 895 <br />5 <br />
