r JUN 26� I <br />1985 BOOK a Pa' 99 <br />RECOMMENDATION: <br />It is recommended that the Board of County Commissioners <br />authorize staff to forward the following comments regarding <br />this project to the D.E.R.: <br />1) Indian River County has no major objection to the proposed <br />- project; <br />2) It is recommended that an armor toe be placed on the base <br />of the stabilization structure; <br />3) Site plan approval, as well as a variance to construct the <br />docks will be required from Indian River County; <br />4) The D.E.R. and other appropriate agencies should consider <br />the navigational aspects and potential impacts on the <br />project upon the Florida manatee. <br />Mr. Challacombe explained that staff's only concern is the <br />cumulative impact of several other requests for dock projects; he <br />noted that James Cain has submitted an application to construct <br />40 boat slips in a series of 3 docks along Jungle Trail and Sea <br />Oats also is looking to build some sort of dock structures. <br />Staff is concerned as to the overall impact when you combine <br />these with the potential DRI of Grand Harbor with over 600 boat <br />slips. Several agencies will be discussing these concerns with <br />regard to protecting the manatees and the threshold and capacity <br />of the river at tomorrow's meeting of the Wild Life Commission. <br />Chairman Lyons asked about parking for these docks, and Mr. <br />Challacombe explained that under the existing ordinance, we <br />cannot approve these docks without some sort of variance <br />procedure since they have not received site plan approval as yet. <br />Commissioner Bird wondered if we could somehow require that <br />they not construct the docks until the primary uses are approved. <br />Attorney Brandenburg advised that they cannot build the <br />0 <br />docks even if they get the permit approved by the DER until they <br />receive site plan approval from the County for the primary use <br />that is allowed on the site, plus site plan approval for the dock <br />facility itself. He believed this is the old argument of whether <br />to apply first for a DER permit before applying to the County so <br />you can say it is already permitted, or whether you apply to the <br />37 <br />
