- W W <br />County first and take the chance of someone saying it is <br />premature without having the DER permit. <br />Ruth Stanbridge, Chairman of the Scenic Roads and Trails <br />Committee, recalled that when the Committee first looked at this <br />area for erosion control by the County, they applied to the Corps <br />for a general permit and came extremely close to getting that <br />permit when Florida Land Company pulled an administrative <br />hearing. As a result of that administrative hearing, an <br />agreement was reached whereby they would do the erosion control <br />and we would try to relocate the roadbed in the right-of-way and <br />tie it down totally. However, that was simple for erosion <br />control, docks were never discussed. <br />Attorney Brandenburg agreed that the County did not make any <br />statement one way or another with regard to docks . However, at <br />the time the County entered into the agreement to realign the <br />right-of-way, the County knew that Florida Land Company's purpose <br />was to clear up the title on land adjacent to the river so that <br />they would have the right-of-way for docks. The County did not <br />say at that time whether we would approve of the docks or make a <br />negative comment on them, and that is really the issue before the <br />Board .today. He advised that the stabilization or erosion <br />control permit should proceed independently of the dock issue. <br />MOTION WAS MADE by Commissioner Wodtke, SECONDED by <br />Commissioner Bowman, that the Board approve staff's <br />recommendation as set out in the above memo with <br />respect to Florida Land Company erosion control <br />permit application #31-104841-4. <br />Attorney Brandenburg suggested that the County go one step <br />further and say that not only do we not object to it, but we are <br />in favor of it because Florida Land is doing this at the County's <br />request. He felt that we should urge the DER to issue the <br />erosion control permit as quickly as possible. <br />38 <br />JUS � g BOOK 61 RGE400 <br />
