Commissioner Scurlock felt that what Chairman Lyons is <br />saying is that we have a lot of people out there who are tired of <br />not knowing what is going to happen to them and want to know <br />whether or not there is going to be a shopping center in back of <br />a <br />them and get on with it. That is what he has got from the <br />residents in the area, and Chairman Lyons stated that was his <br />feeling also and wondered what the best vehicle would be. <br />Mr. Shearer clarified that he was not recommending that the <br />Board necessarily postpone it, but if they do, staff would like <br />to do it on December 4th. <br />Attorney Clem stated he had no objection as they want to get <br />it done also and repeated that they are not here to represent <br />that they are going to get everybody lined up -- they might and <br />they might not -- but they would like to have an opportunity to <br />present their plans to them. He reported that the residents had <br />a meeting on Monday evening of this week, but there just has not <br />been enough time to get everything pulled together. If the <br />meeting is to be December 4th, then it is December 4th. <br />it. <br />Mr. Shearer suggested that the developer could reschedule <br />Commissioner Wodtke understood in that case the applicant <br />has the option to withdraw the request rather than to postpone <br />it. <br />Commissioner Scurlock did not feel that we had any choice <br />because the option for the applicant is to withdraw his request <br />and then he can resubmit it at the next time period. <br />Mr. Shearer explained that the Board can hear it today as <br />scheduled or postpone it until December 4th when the new Comp <br />Plan land use amendment applications come through. Another <br />alternative would be for the applicant to withdraw the request, <br />and the fourth alternative would be for them to come back in <br />January and reapply. <br />Attorney Vitunac explained that his office has been seeing <br />some restrictive covenants prepared by Attorney Clem's office and <br />40 <br />OCT 16 7985 62 FADE 3 <br />
