NOV 13 1995 BOOK 62 EAu 742 <br />substantial progress on the project between now and another six <br />months. <br />Attorney Vitunac advised that the Appendix of the Zoning <br />Ordinance states that "construction shall be considered abandoned' <br />or suspended if it is shown that an active building permit has <br />not been maintained for construction of a structure, etc... or it <br />is shown to the satisfaction of the Board of County Commissioners <br />that construction at a level indicating a good faith effort to <br />proceed with the completion of the project has not occurred for a <br />continuous period of six months. <br />Commissioner Scurlock believed that gives the Board the <br />ability today to stipulate that the roads, drains, and utilities <br />will all be done in six months. <br />Attorney Vitunac explained that staff is waiting for <br />instruction to either schedule another progress report or a <br />public hearing for termination of site plan. <br />Considerable discussion took place on whether or not to <br />schedule a public hearing in six months whether that was a <br />reasonable amount of time for the Clarks to complete water, sewer <br />and power. <br />Attorney Glenn asked his client what he considered would be <br />a reasonable amount of time to complete this, and Mr. Clark felt <br />that six months would do it as they plan on phasing it in. <br />MOTION WAS MADE by Commissioner Bird, SECONDED by <br />Commissioner Wodtke, that the Board schedule a public <br />hearing in six months for the purpose of terminating <br />the site plan, unless it is demonstrated at that public <br />hearing that in addition to a wastewater franchise <br />being issued, the following items have been completed <br />to sufficiently service the 22 lots in Phase l: water <br />distribution system, sewage collection system and <br />treatment plant, electrical distribution system. <br />34 <br />
