E. REFERENCES: F.P. Pendleton, City of <br />Public Works Directo Vero Beach, to Board of County <br />Commissioners dated <br />UnCt. 3t, t985 <br />The City of Vero Beach is requesting a utility easement along the west 40' <br />of the new Jail Property south of South Gifford Road. Whereas the west 20' <br />of the property will be vegetated buffer, the east 20' of the west 40' will <br />be primarily used as a utility corridor. <br />RECOI►�VDATIONS <br />Staff recommends granting an easement to the City along the west 40' of the <br />new Jail property subject to the west 20' being left in it's natural <br />vegetative state. <br />Chairman Lyons pointed out that deed of easement says <br />nothing about maintaining the west 20' in its natural vegetative <br />state. <br />Director Davis reported that this was agreed on verbally <br />with Frank Pendleton of the City of Vero Beach, and further noted <br />that the City already has put some poles in this area and they <br />haven't disturbed any of the vegetation on the west. He believed <br />such language could be inserted if the Board so desired, however. <br />Chairman Lyons felt this is very important as such things <br />tend to get forgotten if they are not specifically set out. <br />ON MOTION by Commissioner Scurlock, SECONDED by Commis- <br />sioner Bowman, the Board unanimously directed that <br />language be inserted in the Deed of Easement re the west <br />20' being left in its natural vegetative state. <br />(Copy of Said Deed will be made a part of the Record <br />when fully executed and received.) <br />14 <br />
