1. It is understood and agreed by and between the <br />parties hereto that the above-described premises shall be used by <br />the Lessee exclusively for mudbogging events for the use and <br />benefit of the public who desire to use same, and that Lessee <br />will make all the necessary improvements on said property in <br />order to accommodate mudbogging, at Lessee's own expense. <br />2. The Lessee agrees not to use or permit the use of <br />said premises, or any part thereof, for any unlawful purpose or <br />offensive use, and further agrees that the same shall be used <br />solely for the purpose of mudbogging or other community <br />recreational events. Lessee agrees that the leased premises may <br />be used by other organizations for mudbogging events under <br />reasonable terms and conditions. <br />3. This lease shall not be assigned and no part of the <br />leased premises shall be sublet nor used for any purpose other <br />than that expressed in this lease without the express consent of <br />Lessor. Any public body, charitable organization, or other <br />entity which sublets or uses any portion of, the leased premises <br />shall carry insurance as described in paragraph 7. <br />4. In the event of the failure on the part of the <br />Lessee to comply with any of the terms or conditions of this <br />lease on its part made and provided to be performed, or upon a <br />finding by the Board of County Commissioners that the use of the <br />premises as described creates more of a burden to the County than <br />is warranted by the recreational benefits derived therefrom, the <br />Lessor may, upon written notice to the Lessee, declare this lease <br />to be in default and, after 90 days of uncorrected default, <br />Lessor may terminate this lease. <br />5. Any and all improvements made by the Lessee shall <br />become the property of the Lessor at the time of the expiration <br />of this lease, and further Lessee shall make no claim on any of <br />said -improvements. <br />6. Lessor shall reserve to itself the right to let, <br />lease or allow use of any other portion of the premises or the <br />site for any public purpose, provided such does not unduly <br />interfere.with the operation of Lessee's mudbogging events. <br />JAN 2 2 196 -2 <br />Bou 63 410 <br />
