4 <br />ALTERNATIVES & ANALYSIS: <br />The Planning and Development Division reviews and submits <br />comments on dredge and fill applications to the permitting <br />agencies based upon the following: <br />The Conservation & Coastal Zoning Management Element of <br />the Indian River Comprehensive Plan <br />- Coastal Zone Management, Interim Goals, Objectives & <br />Policies for the Treasure Coast Region <br />The Hutchinson Island Planning & Management Plan <br />The Indian River County Code of Laws and Ordinances <br />On February 25, 1986, Staff issued an Indian River County <br />mangrove alteration permit (MA #86-002) for the proposed <br />project, in accordance with Section 231, Tree Protection, of <br />the Indian* River County Code of Laws and Ordinances. Section <br />23}-9 of the Code specifically lists criteria to be met in <br />achieving compliance with County regulations; the applicant has <br />assured Staff that proposed alterations will satisfy those <br />criteria. In that respect, Staff has no objection to the <br />issuance of a Department of Environmental Regulation Mangrove <br />Alteration permit to the applicant for the proposed project. <br />RECOMMENDATION: <br />it is recommended that the Board of County Commissioners <br />authorize staff to forward the following comment regarding this <br />project to the Florida Department of Environmental Regulation: <br />Indian River County has no objection to the issuance of a <br />D.E.R. Mangrove Alteration permit for the proposed project, in <br />that the project as proposed satisfies County Code regulations. <br />Commissioner Bowman noted that this very large area contains <br />over 500 mangrove trees and wondered who is going to monitor this <br />work. She questioned whether taking off the bottom limbs is <br />allowed under "hedging". <br />Art Challacombe, Chief of Environmental Planning, advised <br />that staff will go out and spot check the results of this annual <br />trimming to see if they are in compliance. Most of the work <br />involved is trimming dead limbs and bottom branches after the <br />winter freeze period. The red mangroves got hit very badly by <br />the freeze. He noted that staff will be workshopping the entire <br />Tree Protection Ordinance on April 17, 1986. <br />ON MOTION by Commissioner Wodtke, SECONDED by <br />Commissioner Bowman, the Board unanimously (3-0) <br />approved staff recommendation to forward a comment <br />of no objection to the proposed project. <br />15 <br />BOOK U P�1GF 994 <br />6 -MAR 2 6 1986 <br />
