Miller /lKA4 <br />Chief, Current Development <br />FROM: Stan Boling REFERENCES: <br />Staff Planner A• <br />6. <br />Palm Gardens <br />STAN3 <br />It is requested that the data here_r;oe given fo�::_� <br />consideration by the Board : ; C_yl Commissioners at their <br />regular meeting of May 7, 1986. <br />DESCRIPTION & CONDITIONS: <br />The subdivision ordinance (83-24) states in section 6(a) ,that it <br />is unlawful for any person to: <br />"Divide any- lot in. a platted subdivision that was <br />approved- by the Board of County Commissioners, in a <br />manner which results in construction sites smaller than <br />or inconsistent with the surrounding lots in the sub- <br />division -unless approved by the county commission...". <br />Thus, persons wishing to split a standard sized lot in a platted <br />subdivision that would result in lots smaller than the surrounding <br />lots must receive -approval from the Board of County Commissioners. <br />Such requests are to be heard by the Board after written notice <br />has been sent to the owner of each lot in the affected <br />subdivision. <br />Mr. Kery Jones and Tom Reno, owners, are now requesting that the <br />Board grant them approval to split Lot 4 of Block 3, Palm Gardens <br />subdivision, into two equal sized lots. Such a split would create <br />a 95' x 195' lot for an existing mobile home on the property and a <br />vacant 95' x 195' lot for the placement of a new mobile home. <br />ALTERNATIVES AND ANALYSIS <br />In accordance with the subdivision ordinance, written notice of <br />the May 7th consideration of this request has been sent to each <br />owner in Palm Gardens subdivision. The ordinance does not specify <br />criteria to be used in the consideration of such lot split <br />requests. However, the intent of the lot split notice requirement <br />and consistency with the zoning code and Comprehensive Plan <br />warrant the following criteria: <br />Prior to approval of a lot split, the Board should determine that: <br />1) no negative neighborhood impacts are anticipated; <br />2) the resulting lots conform to the applicable zoning <br />requirements; <br />72 <br />
