Commissioner Bird believed if the current two OCR pieces <br />were designated a neighborhood node, which is 3 acres, that would <br />preclude expanding it further, but Planner Shearer pointed out <br />that the Comprehensive Plan would prohibit a neighborhood node at <br />this location because of the MXD immediately across the street. <br />Discussion ensued as to just what a reasonable use of <br />Parcels 1 and 2,would be with Attorney Quinn maintaining that <br />the appropriate use is OCR. <br />Chairman Scurlock noted that the Bank bought Parcel #3 and <br />he did not know what they could do with that; possibly they could <br />sell it back to Vista. He stated his personal preference would <br />be to leave Parcels i and 2 OCR and Parcels 3 and 4 RM -10 which <br />is what they currently are. <br />Attorney Henderson emphasized that Parcels 1 and 2, which <br />contain 3.7 acres, are OCR because of an existing use. Their <br />proposal is that the Board allow them the smallest amount of <br />commercial consistent with the original plans of the developer <br />and make that 3.7 acres CN, the most restricted commercial zone <br />available, and they then will put offices on the parcels on the <br />south side of Vista Royale Blvd, which no one seems to have much <br />trouble with. If Parcels 3 and 4 are left RM -10, he felt the <br />Commission is condemning the property to be a buffer area. <br />The Chairman noted that is just Attorney Henderson's <br />opinion, and he did not agree. <br />Sam Alia, Chairman of Vista Royale Property Protection Com- <br />mittee, was surprised no one knew Barnett Bank does not intend to <br />build a branch bank on their parcel, but that they have a <br />retainer for a Do -nut Shop. <br />Fred West of Barnett Bank informed the Board that he had <br />been asked to have that contract withdrawn sometime ago. He also <br />pointed out that OCR doesn't allow a Do -nut Shop; so, he felt <br />that should alleviate any fears in that regard. <br />It was determined that no one else wished to be heard. <br />33 <br />JUL 2 9 1998 -So <br />L, <br />800 M f E 255 <br />
