SEP <br />2 1936 <br />BOOK 65 FA4,�586 <br />DISCUSSION ABOUT SCHOOL BOARD'S <br />NONCOMPLIANCE IN SUBMITTING <br />SITE <br />PLANS FOR CONSTRUCTION OF NEW SCHOOLS <br />Attorney Vitunac requested permission to file suit against <br />the School Board for their failure to obtain site plan approval <br />before beginning construction on several new schools. He felt <br />the issue has to be solved on whether the School Board has to <br />comply with the requirements of the Comprehensive Land Use Plan. <br />Although the State has said that all School Boards throughout the <br />state are trying to cooperate, our School Board has not. The <br />Planning Department has offered to review the site plan without <br />charge, offered fast track scheduling, and waived many other <br />requirements, but we have received absolutely no cooperation. <br />Litigation is the last resort, because otherwise, we are going to <br />sit by and watch schools go up without any review by the County <br />planning staff. <br />MOTION WAS MADE by Commissioner Lyons, SECONDED by <br />Commissioner Bowman, that the Board authorize the <br />- County Attorney to pursue negotiations with the School <br />Board, and if it becomes necessary, proceed with <br />litigation in this matter. <br />Chairman Scurlock believed the County has done everything we <br />can -to cooperate with the School Board. He noted that there has <br />been significant offsite drainage problems at the Thompson <br />School, along with ingress and egress problems at practically all <br />of the schools, and felt that there are major impacts on adjacent <br />property owners which should be under the scrutiny of the County. <br />Commissioner Bird was concerned because Dr. Burns had <br />indicated to him that he was willing to sit down and discuss <br />this. He felt that suing the School Board is Like filing suit <br />against your sister and would be reluctant to do so. <br />Ken Evitt, Administrative Assistant of the School Board, <br />stated that after Attorney Vitunac called the School Board last <br />48 <br />
