L_I <br />TO: The Board of County Commissioners <br />M <br />DATE: September 17, 1986 <br />SUBJECT: demnation of Health Department Property <br />FROM: P. Wilson <br />U*WS__IS_tant County Attorney <br />The attached resolution must be approved by the Board of <br />County Commissioners in order to establish the basis for <br />condemnation proceedings on the above -referenced project. <br />Upon approval of this resolution by the Board, this office <br />will immediately file the lawsuit condemning tide properties <br />described in the resolution. <br />Attorney Wilson noted that staff was authorized to proceed <br />with this. They have had the appraisal prepared stating the fair <br />market value, but prior to filing the lawsuit, the law requires <br />that the Board pass a resolution stating the need for -the <br />facilities, etc. <br />Chairman Scurlock questioned the Whereas clause on page 2 <br />which states that the Board has allocated funds for the purposes <br />stated in the Resolution. He did not believe the Board has done <br />that and had trouble voting for a Resolution that says we have <br />done something that we have not done. <br />Attorney Wilson noted that he has discussed this with the <br />OMB Director, and he sai-d the Board either has to do a budget <br />amendment or do some interfund borrowing. These funds must be <br />filed with the court. <br />Commissioner Bird inquired how many of the parcels involved <br />have homes on them, and Attorney Wilson believed that there are <br />two. He continued that, according to General Services Director <br />Dean, the urgency right now is to get the property in the <br />county's name so the City can proceed to abandon the roadways <br />where we want to put the structure. We are not in a tremendous <br />hurry to move the people out and will continue negotiating with <br />them. <br />Chairman Scurlock did not have any question that we need to <br />move ahead, but believed we must have some funds allocated. <br />04VA <br />SEP 23 1986 <br />BOOK 0 F�,.GG <br />
