1. Utilities: positive impact due to the provision of water and <br />wastewater for all lots, including expansion and introduction <br />of wastewater facilities into the neighborhood. <br />2. Transportation: no negative impact from the proposed 69 lczz- <br />according to the applicant's own 'traffic analysis and revi,::•r <br />by the County traffic engineer; positive impact due to a <br />16th Street right-of-way dedication and provision of a <br />sidewalk along 16th Street (north side). <br />3. Drainage: no negative impact due to stormwater managere_= <br />requirements applied during review of construction drawi c- <br />(land development permit). <br />4. Lot Sizes: no negative impacts due to provision of to <br />meeting and exceeding the RS -3 minimum lot size requirem--::- <br />of 12,000 sq. ft. with -.,:the smallest lots (12,000 sq. ft.; <br />located in the rear of the subdivision along the Main Re— <br />I--'----Canal. right-of-way. Lot sizes meet or exceed the siLas <br />currently allowed in the rest of the neighborhood. <br />Based on the foregoing analysis it is staff's opinion that <br />proposed preliminary plat application does not adversely af`:,--- <br />the neighborhood in which the project is located. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners overtii_z <br />the Planning and Zoning Commission denial and grant preliminary <br />plat approval for the Queen's Terrace subdivision. <br />Chief Planner Boling believed the lot size is a point of <br />controversy for the area, but the lots both meet and exceed the <br />zoning requirements. <br />Chairman Scurlock asked the legal opinion of the County <br />Attorney as to the lot size being adequate under the ordinance. <br />Attorney Vitunac informed the Board that the hearing today <br />is a "de novo" hearing, and in such a hearing the Commission does <br />not sit as a review board looking over the facts presented to the <br />Planning & Zoning Commission, but makes an independent judgment <br />based on the facts presented today by both sides.
