1987 <br />AR I BOOK 67 <br />We don't know yet the level of cooperation we will receive from <br />the owners of the Caldwell, Gregory and Hoffman properties to the <br />east. Those owners have set up a type of consortium and pooled <br />their resources in order to propose a development plan that <br />involves 300 acres of land, setting aside 250 acres as enhanced <br />wetlands. They have met with the Governor's task force on the <br />management of marshes, the DER, and other agencies that are <br />involved in the permitting process. At this point in time those <br />agencies seem to be interested in their proposal; however, it has <br />not been finalized. We are waiting to see if anything is going <br />to come of that, but at the same time we want to proceed with <br />this project. If we cannot do any mitigation in that area, we <br />would like to go offsite and mitigate along the Indian River. <br />Chairman Scurlock asked why we just don't go ahead with <br />acquiring those wetlands, and Director Davis felt there is a <br />legal question as to whether we can condemn that many acres of <br />wetlands for this project. <br />Chairman Scurlock felt that if everyone took the position of <br />not selling their land, our only option would be to go to condem- <br />nation. Since that area is so sensitive, he would prefer buying <br />it all at a reasonable cost. <br />Director Davis advised that the study found that the <br />permitting agencies will allow us to mitigate offsite; therefore, <br />the property owner could argue that we do not have to take his <br />property since we can go elsewhere to mitigate. <br />Chairman Scurlock felt we are going to have an argument with <br />those property owners no matter what, and believed that the main <br />objective of their consortium is to develop.land in there with <br />some sort of a project. He was not sure that anybody should <br />build anything over there, and Commissioners Eggert and Bowman <br />agreed. <br />Attorney Vitunac explained that the first step in any <br />
