APR 14 1987 BOOK s PA�i,r loo <br />8) During construction (including excavation) of the <br />proposed marina basins, estuary/waterways, or surface <br />water management system, soils contaminated with DDT or <br />other restricted agricultrual compounds shall be removed <br />and used as fill for the golf course and/or building <br />pads. Deposition of contaminated material on the golf <br />course shall be deposited above the seasonal high water <br />table and covered with no less than one foot of clean <br />fill or topsoil. [D.O. Condition No. 91 <br />9 ) Prior to the issuance of a certificate of occupancy for <br />any structures, the esturarine/waterway system shall be <br />connected to the Indian River Lagoon. No connection of <br />the excavated estuarine/waterway system shall be made to <br />either the lagoon or the existing connected open water <br />basin (marina 1) until such time as DDT, other restricted <br />constituents, and standard water quality parameters <br />within that system have been reduced to levels at or <br />below background levels of such constituents within the <br />Indian River Lagoon, and until such time as shorelines <br />have been stabilized and the littoral zone habitats along <br />the edge of the wetland areas and estuarine/waterway <br />system have been planted and work inspected by Treasure <br />Coast Regional Planning Council and Indian River County. <br />The developer shall at his own expense, submit tests that <br />show the estuarine/waterway system to be at or below <br />background levels of DDT and other restricted <br />constituents. Tests shall be preformed by an independent <br />laboratory selected by the developer and approved by the <br />County. The County Environmental Health Department shall <br />monitor the test results. [D.O. Condition No. 111 <br />10) In the event that it is determined that any <br />representative of a plant or animal species designated as <br />endangered or threatened on Federal, State of Florida, or <br />Florida Committee on Rare and Endangered Plants and <br />Animals lists is resident on, or otherwise is <br />significantly dependent upon the Grand Harbor property, <br />the developer shall cease all activities which might <br />negatively affect that individual or population and <br />immediately notify both the Florida Game and Freshwater <br />Fish Commission and the U.S. Fish and Wildlife Service. <br />Proper protection, to the satisfaction of both agencies, <br />shall be provided by the developer. [D.O. Condition No. <br />19] <br />11) The perimeter of the golf course shall be.bermed and <br />swaled to prevent direct runoff from entry into the <br />surface water management system of lakes, the constructed <br />marina basins, the estuary/waterway system or the Indian <br />River Lagoon. [D.O. Condition No. 281 <br />12) The developer shall coordinate the timing of his <br />construction schedule such that immediately prior to the <br />period when connection of waterways on-site to the <br />existing basin or to the Indian River Lagoon takes place, <br />pumping of water to lower the water table on-site (entire <br />project site) shall cease. No pumping shall take place <br />after the connection is made. [D.O. Condition No. 121 <br />13) The developer shall submit to planning and public works <br />staff, all correspondence and submittals to State and <br />federal agencies regarding permits and permit conditions <br />(eg monitoring reports, test reports, funding). <br />14) Prior to commencement of any work within the estuarine <br />area, the developer shall arrange with and meet County <br />environmental planning staff at the site to establish <br />pre -construction conditions. At the time of the on-site <br />meeting, the developer shall arrange with the environmen- <br />tal planning staff a schedule of site inspections. <br />
