ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Wheeler, the Board unanimously authorized <br />issuance of the land development permit for the! <br />Grand Harbor estuarine system based on the conditions <br />outlined in attachment #3, as recommended by staff. <br />Chief Planner Boling noted that staff would like to request <br />that the rest of the land development permits be handled at staff <br />level if the Board has no desire to see them. <br />In the following discussion, Board members generally indi- <br />cated that they would like to continue to see these. <br />GRAND HARBOR DEVELOPER'S AGREEMENT <br />The Board reviewed memo from County Attorney Vitu6ac: <br />TO: Board of County Commissioners <br />FROM: Charles P. Vitunac, County Attorney <br />DATE: April 8, 1987 <br />RE: AGENDA - BCC 4114/87 <br />ATTORNEY'S MATTERS <br />GRAND HARBOR DEVELOPER'S AGREEMENT <br />In conjunction with the development of Grand Harbor it is <br />necessary for the developer to confirm the availability of <br />water and wastewater utility services for the project. The <br />attached two contracts, which together form a Developer's <br />Agreement, are recommended for approval by the County staff <br />and have been executed by the developer. <br />The agreements reserve 1,000 equivalent residential units <br />worth of water and wastewater capacity to Grand Harbor and <br />require that at least 250 ERUs be paid for in cash at the <br />time building permits are pulled or a higher number if the <br />number of building permits requested exceeds 250. In <br />addition, simultaneously with the payment in cash, a letter <br />of credit must be issued in favor of the County for payment <br />of the remaining number of impact fees for which payment in <br />cash has not been made.
