matter, and they say they are suing us because if they didn't, we <br />would be the subject of a federal lawsuit by private attorneys <br />trying to get triple damages. They are giving us every <br />opportunity to remedy the situation. <br />Attorney Vitunac informed the Board that we are going to <br />court in the middle of July, and he hoped Commissioner Wheeler <br />will be our witness and testify concerning the Fast Track <br />Committee, Phases I, II and III, and everything else we are <br />doing. In the meantime, Tallahassee has given counties an <br />opportunity to pass an additional 1% sales tax for capital <br />structures, and if we are to pursue this, we must act before next <br />March. Attorney Vitunac explained that he is bringing this up <br />now because when we go to court it would be nice to say we are <br />using every means available to us under law to pay for this new <br />jail, and he would like the Board to authorize staff to do a <br />fiscal analysis of how much money we could raise so he could show <br />the Judge we have a valid plan for funding Phase Ill. <br />MOTION WAS MADE by Commissioner Wheeler, SECONDED by <br />Commissioner Eggert, to authorize staff to do a fiscal <br />analysis of money that could be raised from the addi- <br />tional tax, as requested by the County Attorney. <br />Commissioner Bird asked if this tax, which can be put into <br />effect for 15 years, doesn't have a potential to fund capital <br />improvements other than just the jail. <br />Attorney Vitunac agreed there is the option of limiting it <br />to only the jail for the number of years that would be required <br />to pay for the jail, or we could go for the maximum years and use <br />it for other capital improvements, i.e., the Courthouse, <br />park improvements, etc. <br />THE VICE CHAIRMAN CALLED FOR THE QUESTION. <br />It was voted on and carried unanimously (4-0). <br />JUN 16 198-1 45 BOOK 6 8 r�t 587 <br />
