Surrounding Land Uses/Zoning: <br />South: Residence/RS-3, Residential Single Family <br />East: Atlantic Ocean <br />West: Vacant/RS-6, Residential Single Family <br />North: Residence/RS-3, Residential Single Family <br />8. Specific criteria for guest cottages: [Sec. 25.1(c)]. <br />i. Shall be an accessory structure or portion of a <br />principal single family dwelling. <br />ii. Shall not be located closer than fifteen (15) feet to <br />the principal dwelling on the lot. <br />iii. No guest pottage may be utilized for commercial <br />purposes. <br />iv. The guest cottage ;L�Yiall only be used for the inter- <br />mittent or temporary occupancy by a non-paying guest. <br />Section 25.1 of the Zoning Code, Regulations for Specific Land <br />Uses, details specific criteria to be considered when'reviewing a <br />guest cottage for approval as a special exception use. All of the <br />criteria have been met. The special exception process allows the <br />Board of County Commissioners to impose any additional conditions <br />to ensure compatibility of the proposed use with surrounding <br />property, and the staff recommends the imposition of a <br />requirement that the applicant record -a document in the public <br />records that prohibits the guest house from ever being rented. <br />RECOMMENDATION: <br />Based on the above analysis, staff recommends that the Board of <br />County Commissioners grant special exception approval with the <br />following condition: <br />1. Prior to release of the approved site plan, a document, <br />acceptable to the County Attorney, shall be recorded in the <br />public records stating that the guest cottage shall not be <br />rented separately from the main house. <br />Commissioner Bird asked.if there was a possibility that the <br />guest cottage could be chopped off and become a separate house, <br />and Planner Stan Boling stated that it is possible with the <br />removal of some of the structures. However, if that is attempted <br />in the future, staff would check the setbacks and see if that <br />could be done. <br />The Chairman opened the Public Hearing and asked if anyone <br />wished to be heard in this matter.
